These terms apply to heartlandnext.com and to MyAds, the reporting hub where our clients sign in to see how their advertising is performing. Heartland Digital LLC, doing business as Heartland Next, operates both. Using either means you accept what is written here.
If you are a client, the agreement you signed with us governs the work itself. Where that agreement and these terms disagree, your agreement wins.
MyAds is available by invitation only. We add a person at the request of the client whose reporting it is, and signing in does not create an account: an email address we have not added is told that access has not been set up for it.
Your access is yours. Do not share your sign in with anyone, including colleagues who should have their own. If someone on your team needs access, or someone who has it has left, tell us and we will make the change the same day.
You may see one client’s reporting, which is your own. Do not attempt to reach another client’s data, and tell us promptly if you believe you have.
The figures in MyAds come from the advertising platforms themselves, which is to say from Meta, Google Ads and StackAdapt. We read them, we do not adjust them, and we report what those platforms report.
Those platforms restate their own numbers for several days after the fact. That is normal and it is why the hub re-reads the last week on every update rather than only the previous day. A figure you saw yesterday may be slightly different today, and the later number is the better one.
Attribution is a platform’s own judgement about which advertisement deserves credit for an action. Platforms differ, and some of them credit an advertisement a person saw as well as one they clicked, which is why actions can outnumber clicks on those lines. The hub says so where it happens. Reporting describes what happened. It is not a promise about what will happen next.
Nothing in MyAds is an invoice, a billing statement, or a record of amounts due. Billing is handled separately under your agreement with us, and where a figure in the hub and a figure on an invoice appear to disagree, the invoice is the record.
We aim to have each morning’s reporting in place by 7:00 AM Eastern, and we expect the hub to be available whenever you want it. Neither is a guarantee. An advertising platform can be slow or unavailable, and when that happens the hub shows the most recent data it was able to read. We may take the hub down for maintenance, and we will give clients notice when we can.
The privacy policy explains what we collect, what we receive when you sign in with Google, how long we keep it, and how to ask us to delete it. It is part of these terms.
The performance data in your reporting describes your own advertising, and it stays yours. We do not sell it, and we do not share it with anyone but you and the people you have asked us to give access to.
You may ask us to close your access at any time and we will do it. We may suspend or end access where an engagement has ended, where access is being shared or misused, or where we are required to. When an engagement ends we remove the client’s reporting from the hub, and we delete the underlying performance data on request.
The hub, the site, and the way they are built belong to Heartland Next. The advertising creative, campaign materials and data produced for a client under an engagement belong to that client on the terms of their agreement with us.
MyAds is provided as it is. To the extent the law allows, Heartland Next is not liable for indirect or consequential loss arising from the use of the hub or from reliance on a figure in it, and our total liability relating to the hub is limited to the fees paid for the engagement it reports on. Nothing here limits liability that cannot be limited by law.
We will update these terms when our practices change. The revision date at the top of the page reflects the most recent version. Material changes affecting active clients will be communicated directly.
These terms are governed by the law of the State of Ohio, and any dispute belongs in the state or federal courts sitting in Hamilton County, Ohio.
